Harju County Court’s judgement regarding Selver AS

Harju County Court announced the judgement regarding the criminal case No. 1-14-3730 on 29 April 2015. Harju County Court convicted AS pursuant to Subsection 400 (4) of the Penal Code, and imposed a pecuniary punishment in the sum of 2,956,000 euros, whereof 295,600 euros shall be served immediately if the court judgement enters into force, and the remaining part will not be enforced, if Selver AS will not commit an intentional criminal offence within the 1-year probationary period. Tallinna Kaubamaja Grupp AS emphasizes that the court judgement has not entered into force and Selver AS will challenge it in full for fundamental breach of material and procedural provisions. Selver AS confirms that it has not nor ever will enter into any cartel agreements.

On 29 April 2014, Tallinna Kaubamaja Grupp AS released a stock exchange notification regarding the prosecution of its subsidiary, Selver AS. According to the charge, Selver AS, Rimi Eesti Food AS, Maxima Eesti OÜ, Prisma Peremarket AS, AS Helter-R and AS Liviko agreed on raising the retail price on certain vodkas in 2009 and the companies were accused of committing a crime specified in Subsection 400 (4) of the Penal Code. Selver AS has regarded the prosecutor’s accusation unfounded and unreasonable during the entire course of the proceedings, because Selver AS has never made any price agreements with the competing companies.
